Terms of Use — 3rd Base Coach (a product of Data Network Analysts “DNA”) Effective Date: November 20, 2025 These Terms of Use (“Terms”) govern your access to and use of the 3rd Base Coach application, website, and related services (collectively, the “Service”). 3rd Base Coach is a product of Data Network Analysts (“DNA”). By accessing or using the Service, you agree to these Terms. 1) What 3rd Base Coach Does 3rd Base Coach provides decision-support tools and guidance for major purchases and services (for example: auto, home, insurance, contractors, electronics, medical/legal, and business services). The Service may provide estimates, comparisons, checklists, negotiation guidance, referrals, and related workflows. 2) Eligibility You must be at least 18 years old (or the age of majority in your location) to use the Service. 3) User Responsibilities You agree to: Provide accurate information to the best of your ability. Use the Service for lawful purposes only. Verify all final terms directly with the provider/seller and obtain final agreements in writing. Keep any account credentials secure and notify us if you suspect unauthorized access. 4) No Professional Advice The Service does not provide legal, financial, tax, insurance, or other professional advice. Any guidance is general information and decision support. You are responsible for your decisions and for consulting qualified professionals when needed. 5) Estimates, Comparisons, and Results Outputs may include estimates based on user inputs and available marketplace data. Prices, rates, availability, and provider terms can change and may differ from what the Service displays. Results are not guaranteed. 6) Referrals, Member Network, and Third Parties The Service may recommend businesses and providers, including members of the 3rd Base Coach Member Network. Recommendations may be influenced by relevance, proximity, and network participation. Providers are independent third parties. DNA does not control, endorse, or guarantee any provider’s products, services, pricing, availability, or outcomes. Any transaction you enter into is between you and the provider/seller. 7) Scheduling and Communications If you request appointment scheduling or introductions: The Service may submit an appointment request on your behalf. Appointments are not confirmed unless the provider confirms. You are responsible for confirming details (time, location, scope, pricing) directly with the provider. 8) Payments and Fees Some features, memberships, or services may require payment. Pricing, billing frequency, and any applicable refund terms will be presented at the time of purchase. If you enroll in a membership or subscription, you agree to the billing terms shown during sign-up. 9) Acceptable Use You may not: Misuse the Service, interfere with operations, or attempt to access non-public systems. Upload malware or harmful code. Use the Service to harass, defame, or violate the rights of others. Submit false, misleading, or fraudulent information. 10) User Content If you submit content (such as documents, screenshots, notes, or issue reports): You represent you have the right to submit it. You grant DNA a license to use it to operate, maintain, improve, and provide the Service. Do not submit sensitive information unless necessary; redact where possible. 11) Intellectual Property The Service, including its software, workflows, text, and branding, is owned by DNA or its licensors and is protected by applicable laws. You may not copy, modify, distribute, or reverse engineer the Service except as permitted by law. 12) Suspension and Termination DNA may suspend or terminate access to the Service if you violate these Terms, misuse the Service, or if required to protect the Service, users, or third parties. 13) Disclaimers THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DNA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 14) Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, DNA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY THIRD-PARTY TRANSACTION. 15) Indemnification You agree to indemnify and hold harmless DNA from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms. 16) Changes to These Terms We may update these Terms from time to time. If we make material changes, we will provide notice within the Service or by other reasonable means. Continued use after changes means you accept the updated Terms. 17) Governing Law and Disputes These Terms are governed by the laws of [Insert State/Country], without regard to conflict-of-law principles.
